Barton was charged with disturbing the peace and the charge was later changed to “offensive conduct in a public place, for using her right to free speech.” Instead of Barton saying "I wish these damn Spics would learn to speak English." to “I wish people would speak English in a public setting, because it would make more people feel comfortable” Barton most likely would not have been charged.
